Terms of Service

These terms are a contract between you and BrainBuzz ("we", "us"), covering playbrainbuzz.com and the BrainBuzz game service. By creating an account, hosting a game, joining a game, or paying us, you agree to them. If you don't agree, please don't use the service.

1. What BrainBuzz is

BrainBuzz is a party game service with three formats: a TV-style trivia board played by teams, a timed multiple-choice quiz played on players' own phones, and a set of short puzzle games ("brain games") that contain no trivia. A host creates a room, either generates the content using AI or builds it by hand, optionally displays it on a TV or monitor, and players join from their phones using a room code. Players do not need an account.

2. Accounts and eligibility

  • You must be 18 or older to create a BrainBuzz account or to pay us.
  • Players do not need an account and may be of any age, subject to section 6 below — the host is responsible for the people they invite.
  • You're responsible for keeping your password safe and for everything done under your account. Tell us promptly if you think it's been compromised.
  • Give us an accurate email address. We use it for verification, password resets, and billing notices.
  • One person or organisation per account. Don't share account credentials.

3. Plans, credits and billing

Hosting games, playing, the TV display, sample packs, and boards you build by hand are free. Paid plans cover AI board generation and a larger saved library. Current prices are on the pricing page.

  • Pro is a recurring subscription that renews automatically — monthly or annually, depending on which you chose — until you cancel. You can cancel at any time from your account page.
  • Credits are a one-time purchase. One credit generates one AI game — a trivia board, a quiz, or a set of brain games. Credits don't expire and don't reset monthly. Brain games built only from the puzzles that generate themselves use no credit at all.
  • Free accounts may keep a limited number of saved boards (currently 10) and receive three free AI boards. Pro accounts are unlimited, subject to fair use.
  • Prices are in US dollars and exclusive of any tax that may apply.
  • All sales are final and we do not offer refunds — everything we sell is digital and delivered immediately. Cancelling stops future charges but does not refund charges already taken. See the Refund Policy, which forms part of these terms, and please use the free tier before buying.
  • We may change prices. Existing subscribers get notice before a change affects their renewal, and can cancel before it takes effect.

Payments are processed by Stripe. We never see or store your full card number.

4. Fair use

"Unlimited" AI generation on Pro is subject to a daily cap generous enough that normal game-night and classroom use will never reach it. It exists so that a single account can't run away with our AI costs. If you hit it, it resets the next day. Automated or bulk generation isn't normal use — see section 5.

5. Acceptable use

Don't use BrainBuzz to:

  • Break the law, or generate content that is illegal, harassing, hateful, sexually explicit, or that targets or endangers a specific person.
  • Generate content in bulk, resell generated boards as your own product, or use the service to build a competing dataset or service.
  • Circumvent limits, rate limits, credits, or paywalls; share accounts; or automate access without our written permission.
  • Probe, scrape, overload, or interfere with the service or the servers it runs on, or attempt to access data that isn't yours.
  • Upload photos of anyone without their permission, or photos of children without the permission of a parent or guardian.

We may suspend or terminate accounts that break these rules, and we may remove content. Where it's reasonable, we'll tell you why first.

6. Hosts, players, and content about other people

If you host a game, you decide who joins and what the board is about. You're responsible for:

  • Getting any permission needed for the names and photos players add — including from a parent or guardian where a player is a child.
  • Following your own institution's rules if you're hosting in a school, workplace, church, or similar setting. Teachers and administrators are responsible for complying with their school's privacy obligations.
  • The content of boards you create, including boards about identifiable people.

Player photos are held only in server memory for the life of the game room and are never written to disk. See the Privacy Policy.

7. AI-generated content

AI makes mistakes. BrainBuzz runs generated boards through an automated fact-check pass, which catches a lot — but not everything. Questions and answers may be inaccurate, outdated, ambiguous, or unsuitable for your audience. Review boards before you play them, especially in a classroom or any setting where accuracy matters.

Do not rely on BrainBuzz content for anything consequential — it's a party game, not a reference work, and it is expressly not suitable for medical, legal, financial, academic-assessment, or safety-related use. You're responsible for reviewing content before presenting it to your players. Your account's board library lets you edit any clue or answer you don't want.

Weekly news boards deliberately skip the fact-check pass, because the checking model's knowledge predates the week's headlines. Treat them accordingly.

8. Who owns what

Your content

Boards you create or generate are yours. You grant us a limited licence to store, process, transmit and display them purely so we can run the service for you — for example, saving a board to your library and showing it on your TV. We don't claim ownership and we don't sell your boards.

Boards you publish

Saved boards are private by default. You can choose to publish one to the public gallery, where anyone with a BrainBuzz account can find it, play it, and save their own copy. Publishing is your choice, per board, and you can make a board private again at any time — it leaves the gallery immediately, though copies other people already saved remain theirs.

By publishing a board you grant us a non-exclusive, worldwide, royalty-free licence to store, reproduce, display and distribute it within BrainBuzz, and to let other users play it and copy it, for as long as it is published. You keep ownership. You also confirm you have the right to publish it — don't publish boards containing other people's private information, or content you don't have permission to share.

You choose whether a published board is credited to your display name or shown as anonymous. We never show your email address. Published boards are screened by an automated content filter before they go live, and we may unpublish any board at any time, with or without notice, if we think it breaks section 5.

Our content

The BrainBuzz software, design, branding and sample packs are ours and are protected by copyright and trademark law. These terms don't give you a licence to copy or redistribute them.

Generated content

Trivia questions are largely statements of fact and generally aren't protectable by copyright. We don't claim exclusive rights in the questions your boards contain, and we can't promise that similar questions won't appear on someone else's board.

9. Availability, changes and beta features

We aim to keep BrainBuzz running but we don't promise any particular uptime. We may change, suspend, or discontinue features, and we may perform maintenance without notice. If we discontinue a paid feature you've already paid for, we'll return the unused portion — that's a correction on our side, not a refund of the kind section 3 excludes.

10. Disclaimer of warranties

BrainBuzz is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We don't warrant that the service will be uninterrupted, error-free, secure, or that generated content will be accurate.

Some jurisdictions don't allow the exclusion of certain warranties, so parts of this section may not apply to you.

11. Limitation of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business opportunity, arising out of or relating to your use of BrainBuzz — even if we've been advised such damages are possible.

Our total liability for any claim relating to BrainBuzz is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50.

Nothing here limits liability that cannot be limited by law, including for fraud, or for death or personal injury caused by negligence.

12. Indemnity

You'll defend and indemnify us against claims, losses and reasonable legal costs arising from your use of BrainBuzz, the content you create or upload, or your breach of these terms — except to the extent the claim arises from our own wrongdoing.

13. Ending things

You can stop using BrainBuzz and delete your account at any time from your account page. We may suspend or terminate your account if you materially breach these terms, if required by law, or if we discontinue the service. If we terminate you without cause, we'll return any unused prepaid amounts. If we terminate you for breaching these terms, we won't. Sections that by their nature should survive termination (ownership, disclaimers, liability, indemnity, governing law) do.

14. Governing law and disputes

These terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in New Jersey, and you and we consent to their jurisdiction. If you're a consumer outside the US, this doesn't remove the protection of mandatory consumer laws in your country of residence.

Before filing anything, please email us — nearly everything is faster to fix that way.

15. Changes to these terms

We may update these terms. If a change is material, we'll give notice by email or in the app before it takes effect. Continuing to use BrainBuzz after that means you accept the new terms. The "last updated" date at the top always reflects the current version.

This policy was written in English. Translations are provided for convenience; if they differ, the English version governs.
